Terms governing the use of 45s, including solo offline play, online multiplayer, fair play rules, virtual items, and account rights.
1. Acceptance of Terms
Welcome to 45s (the "Game"), provided by FortyFives ("we," "us," or "our"). By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not install, access, or play the Game.
These Terms apply to all players, including offline solo players, online multiplayer participants, and visitors to our public websites at fortyfives.app.
2. Limited License & Allowed Use
We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and play the Game on compatible Apple iOS, iPadOS, Android, and other supported devices that you own or control, solely for your personal, non-commercial entertainment.
You agree not to reverse engineer, decompile, disassemble, or derive the source code of the Game (except to the extent permitted by applicable law), nor to modify, redistribute, rent, lease, or create derivative works from the Game without our prior written consent.
3. Heritage Rules, Fair Play & No Pay-to-Win
45s is a heritage trick-taking card game rooted in regional traditions (including Merrimack Valley, Newfoundland, Nova Scotia, and Irish 45s variants). We are fundamentally committed to fair play and authentic rules.
Our rules engine is server-authoritative. In-game card deals, trump selection, bidding ladders, and scoring are deterministic, balanced, and governed by authoritative rulesets.
No pay-to-win mechanics: Purchases never influence deal probabilities, card values, bidding eligibility, or gameplay advantage. Gameplay skill, partnership communication, and strategy are the sole determinants of game outcomes.
4. Offline Single-Player Mode
The Game is fully functional offline in single-player solo mode against local in-process bots. You do not need an active internet connection, an account, or data sharing to play solo.
When playing offline, your preferences, table themes, and local match records are stored solely on your device. We do not transmit or receive gameplay data during offline sessions.
5. Online Multiplayer & Code of Conduct
When accessing online multiplayer features, you agree to play respectfully with family, friends, and community members. You agree not to engage in cheating, table collusion, griefing, harassment, hate speech, or automated bot interference in human matches.
Online matchmaking and multiplayer relays operate through our authoritative servers. We reserve the right to suspend or terminate online multiplayer access for any player who violates this code of conduct or attempts to disrupt service stability.
6. In-App Purchases & Cosmetic Items
The Game may offer optional in-app purchases through the Apple App Store and Google Play Store, such as premium visual themes (e.g., custom table felts, card backs) or custom ruleset creator tools.
All virtual items and themes are licensed, not sold. They have no real-world monetary value, cannot be redeemed for cash, and cannot be transferred outside the Game ecosystem. Purchases are final and subject to the refund policies of the respective app store platform.
7. Disclaimers & Limitation of Liability
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORTYFIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO ACCESS THE GAME.
8. Account Termination & Data Deletion
You may stop using the Game at any time by uninstalling the application from your device and resetting local preferences in the in-app Settings menu.
If you have established an online server identity and wish to request the complete deletion of your associated server records and match history, you may submit a deletion request to [email protected]. We will process verified requests promptly in accordance with applicable privacy laws.
9. Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and applicable federal laws of the United States, without regard to conflict of law principles.
